E&O for Health share

I have a client that doesn't have a SEP. In IL we have no short-term plans. I don't want to use life-X because I think they are walking a thin line with ERISA laws So, I'm combining an indemnity plan with a health-share that they will have until Jan 1st. Is there an E&O policy that will cover that will cover a health-share.
 
I highly doubt it. Health share plans aren't insurance products. From your post it appears you are writing the health-share plan, correct? What I'd do is NOT write the health share plan and cover my rear-end with a letter to the client informing them health share plans are not insured plans....so they enroll at their own risk. I'd also suggest they consider electing any COBRA benefits they may have available, until eligible to enroll in an ACA compliant plan.

There are some risks/cases/prospects you are better off walking away from. We can't save everyone.
