FloridaBlue ACA Plans and HealthSherpa

In order to be appointed with FloridaBlue for ACA products in Florida, you have to be a captive agent and not sell any other carrier's ACA products.

Is there any state law in Florida that would prohibit an agent who is not appointed with FloridaBlue's ACA products to discuss those products and enroll consumers in FloridaBlue plans on HealthSherpa for the referral bonus that HealthSherpa offers?

I dont know of any law, but sherpa is the agent on the policy and doubt they would have the program if not allowed. But is it really worth the $25 referral fee u get?

Is it only $25? My wife is a Fl blue only agent and when she signed into HS today it said they would give her a $150 referral fee. Granted, I didn't look more into it.

It is only $25 for FloridaBlue on HealthSherpa for the referral fee.

If she's a FloridaBlue agent, she definitely should not use their referral program.

I would only use it as a last resort. If I have a client that I don't want to send somewhere else because I'm getting other business from them, etc.

Can I enable EAP for Carriers with whom I'm appointed?

Yes, depending on state insurance laws. You can enable EAP for any Carrier you'd like; however, you remain responsible for complying with all applicable state insurance laws regarding licensure and appointment. The EAP may not be used to circumvent any laws or regulations.

Why not? She can't write another company and she wouldn't use the referral.

Using that program enter's an NPN from a HealthSherpa rep on the consumers marketplace application. So, it would go to FloridaBlue without her NPN. She wouldn't get paid by FloridaBlue and their commission is higher than the $25 that HealthSherpa would give as the referral fee.

EDIT: Sorry, I think I misread your last response. If she just uses HealthSherpa to enroll her FloridaBlue clients and she is an appointed FloridaBlue agent NOT using HealthSherpa's referral program, then her NPN would go on the information sent to FloridaBlue and she would get paid whatever her normal comp is with them.
 
This part is bs. There is no such law.

If you've got an insurance license it's perfectly legal to discuss any product with any carrier with a consumer. We all do it.

I was thinking the same way about discussing the products but seeing this kind of jarred me.

And what do you think about using HealthSherpa's platform to enroll them into an ACA plan using their Enrollee Assistance Program (referral program) if you are not appointed with that carrier? Still legal?

You were right the first time. I've been discussing life and health products for 50 years now. If it was illegal I'm pretty sure someone would have bitched by now.

Personally I have no interest in their referral program. But is it legal?

I'd say yes
