He is the situation, Just spoke with Prospect, Had just enrolled in BC MA plan after Retiring

Using SEP loss of employer cov with Feb 1st effective


However, He wants to enroll in Aetna MA plan

Can I now Use OE, And if so can I do feb 1st or does it have to be march 1st because he has a plan beginning Feb 1st?
 
The rules are somewhat fuzzy about whether someone newly eligible can enroll is multiple plans and the last one in is the one that counts.

If he wants Aetna for February 1st just put it through under the ICEP/IEP election and see if CMS approves it. If not, put it through for March 1st under OEP.

I am guessing if the other plan takes effect first and I get march 1st I lose 2nd pay for new enrollment

Does not matter much its still husb and wife

But I haven't done anything close enough to New date that I noticed before so I am curious

If the Aetna plan is in force before Feb 1st you will get the full commission because the other plan was never active, at least that is my guess. There is plenty of time to do the enrollment and have it processed for Feb 1, I've put some in on the 29th or 30th and they went through easily.
 
I'm guessing that is part a effective date was a while ago? If so you can't use IEP you'll use the SEP like you stated earlier with the Aetna plan. Because the Blue Cross plan was never active it'll be canceled out.

You offer this advice without knowing Part A and Part B start dates?

Throwing mud at the wall to see what sticks is not in keeping with your image of knowing everything about Medicare.

I don't think it is appropriate to discuss IEP or ICEP without knowing Part A and Part B effective dates. It seems to me that when those are known, every agent who has posted in the thread would know whether or not CMS would approve an IEP-ICEP application.

chazm's post reminded me. I think there was another thread awhile back in which the issue was whether use of a sep happens when an application has been done or not until the policy is in force. ( I think I remember you responding in that thread.) The consensus I remember is that the sep was not used unless the policy actually went into effect.

If the BC MA plan is not in effect, I don't know how OEP would apply.
