In an interesting turn of events that may signal tougher-than-expected oversight of Medicare Advantage, the Dept. of Justice (DOJ) under President Donald Trump has filed a motion supporting the previous administration's attempt to regulate Medicare Advantage payments to agents and brokers.f In its response, the DOJ asserts that CMS by law has broad authority to regulate how Medicare plans are sold and how much marketers get paid for that.

"People who think the Trump administration will have a lighter hand on MA marketing will need to look elsewhere for concrete evidence," remarks Tricia Beckmann, principal with Faegre Drinker Consulting, of the recent filing. But it is also not "terribly surprising to see the federal agency assert broad authority over marketing particularly given its responsibilities under MIPPA," she says, referring to consumer-friendly terms of the Medicare Improvements for Patients and Providers Act.

"Regulate" does not mean "cut." He isn't proposing broker cuts....they are saying they simply want to be the only ones to call the shots, as was how it always was, until Biden and his merry band of morons messed it all up and got sued and neutered by brokers/FMO's.

This mini-nothing article is complete speculation as to what SHE thinks will happen. Of course Trump is going to want to have CMS be the ones to oversee what goes on in the program, without outside interference. F'ing duh.

In 2024, BIDEN'S CMS finalized rules capping broker compensation in Medicare Advantage plans, which led to lawsuits from brokers and distributors arguing that the rules were arbitrary and capricious, exceeding CMS's authority, and violating the Administrative Procedure Act.

All Trump is doing is trying to take that control back, seeing as how adults are back in charge and his administration will be able to regulate it with actual brains and common sense, and not extreme radicalism from the marxist left.

Call me when something actually happens. Swing and a miss from the liberals, as per usual.

What's never talked about is carriers themselves are pulling back . Anthem pulled all products the 2 nd week of aep in 6 states . Cigna pulled all ppo products in all states . Also Trump cutting costs and payments everywhere . Why would he not target cost cutting to Medicare one of the biggest outlays ? Yes They like Medicare advantage but it doesn't mean they won't cut costs and squeeze everyone including the agent. Nobody knows what's going to happen . But I surely wouldn't be opening Medicare offices and spending 100's of k on Medicare related items right here .
