A Comm Umbrella May Do The Trick?

Hello all,
So will a commerical umberlla raise the limits on any endorsements within the underlying policy? I'm writing a CGL with primary limits of $1M/$2M and endorsed Sex Abuse at $300k. I need the S.A. to be at $1M also. Would an umbrella do the trick here? A stand-alone S.A. is way too expensive, I've found.

Thanks

Usually a commercial umbrella will only sit over $1m limits. Furthermore, I don't know if an umbrella will extend S.A. limits. I've never tried. Call/email the underwriter and ask them.

I'm aware of calling THE underwriter but most of us on here are brokers. A particular u/w will state her product's limits only. I was asking on here if anyone has heard of such a scenario. The underlying GL is $1M, I'm asking would an umbrella also extend endorsement limits, which are usually quite lower.

You need to call the carriers. Some umbrella policies expressly exclude Sexual abuse, others have broader extensions of the underlying liability policy. You would not want to assure your client that they are covered and then find out that you were wrong because you didn't CALL THE CARRIER

True. But, I would not have written it in the first place. The whole policy hinges on this one fact.

You are writing the CGL, you have a question about that carriers Umbrella coverage, you pick up the phone and ask your question. Your new business depends on getting the correct answer. If the Me Too movement has proven anything it is that anyone can sue for sexual harassment at any time and carrying enough coverage is not something to gloss over

Call the carrier & ask for a copy of the sample Umbrella policy to read it for what it covers & excludes. Also call the carriers claims expert that would handle umbrella claims. Don't ask an underwriter as they don't generally interpret policy language or pay claims, they tell you whether or not a risk is eligible or not & in some cases they are not even licensed

I doubt it covers it & is excluded. Here is a sample of 1 carriers Umbrella language for the exclusion.Screenshot_20200904-125315~2.png

My guess is no, the umbrella will not go over those sex abuse limits. Strictly excess to BI/PD and general aggregate. But please report back with your findings.

Some courts have ruled that the language of Umbrella policies is not as explicit as the CGL and therefore can be attached. Many Umbrella policies do not define event and have been ruled to pay liability where none should exist. Call the Carrier
