Appointment Background Question

I'm a new broker agent and filling out an application for appointment with one of the carriers. I'm a bit confused about one of the questions they ask. Can anybody please help explain how to answer it. The question is as follows:

"have you been convicted of, or pled guilty or nolo contendere to a felony or misdemeanor involving: insurance, investments or a related business, fraud, false statements or omissions, wrongfully taking of property, or bribery, forgery counterfeiting or extortion, or breach of trust?"

I do have some criminal history.

It seems to me though, that this question is asking about any felonies or misdemeanors that have to do with insurance, investments or related businesses.

And then, the following types of offenses done within the iinsurance or investments industry are listed like fraud, false statements or emissions, wrongfully taking of property and so on.

Or, it could be asking something else.
The way this is sentenced and the way it reads, they could be saying have I ever been convicted of a felony or misdemeanor with anything having to do with insurance or something related, and then also have I ever been convicted for any of the offenses they list, like fraud, false statements or emissions, wrongfully taking of property and so on.

What do you think?

Parse it however you want but if you dont disclose your conviction you will get caught on a background check and have some explaining to do if not just an outright decline. Disclose and write an explanation.

If your criminal history isn't related to insurance, investments, or business, I would answer no to that specific question. However, the above is correct that you do need to disclose criminal history unless it has been removed. It will appear in the background check regardless, and disclosing it now will give you the opportunity to explain the situation.

I would contact your FMO and give the same explanation, as some carriers will allow the FMO to decide whether or not you get appointed based on the information that returns in the background check.

Yes, on all of my appointment applications I have been transparent about my convictions. Not trying to hide anything. I even went so far as to submit all the documentation they would need, like charging document and judgment document and so on. Then I included my character references in the application also.

I'm just not understanding the question and want to make sure I'm answering it correctly.

That question is concerning insurance related crimes, but most contracts also ask about personal convictions.

I plead nolo contendere for battery for beating the hell out of my 1st wife's boyfriend 34 years ago and I still have to explain it on almost every contract I fill out. PITA, but be honest.

Thank you. Yes, my fmo knows about my convictions also. I'm unable to get a hold of the person who would be most knowledgeable when it comes to contracting and these appointment application questions, until monday. I'd like to finish it before then if possible.

So, you are also taking the question to being reference to insurance, investment or related business, and that it then lists the offenses they are being specific about within those industries. I looked at a few times and I've kind of gone back and forth about that. Lol.

Well, thanks again for your and fed ups help.

Thanks for your response.

So are you sure this question is in reference to insurance related crimes? Don't take offense I just want to be sure. It seems to me that way also.

I already put forth my convictions, explained them and presented documentation. So, if I listed them there at that question also, it would be a bit redundant. I don't have any insurance related charges or convictions. I do have a theft on my record though from way back, which also has already been presented in the application.

If this question wasn't specifically for the insurance industry, then I would probably include the theft again here, because it could be a type of "wrongful taking of property", but I don't even know what wrongful taking of property is referring to. Lol.

Anyways, this is really important to me so I appreciate your insight.

What do you think?

If you took some property that didn't belong to you, (that's theft); Disclose it.
What they are looking for is Financial Crimes and covering you for Errors and Omissions.

If it happened a long time ago, no-one will hold it against you. Just disclose it with explanation. *About 34% of all Americans have some kinda criminal conviction (and rising).

AS long as you didn't rob a Bank, steal Grandma's SS check or something like that, you should be good~

Thanks. Yep, it's already closed at a different part of the application.

So, do you think the question on the application I quoted here in my post is specifically referring to insurance and related convictions? And that I wouldn't put my theft here but would put it with the other question about misdemeanor convictions?
