Getting Appointed While on Probation

I'm currently working with an agent part time. Unfortunately, I'm currently on a non-conviction deferred adjudication felony probation. I hold a valid license from the department of insurance, but I've been blocked from being appointed as an agent because of that probation. What I'm wondering is are there any companies that don't treat a deferred probation as a conviction and allow appointment? I'll admit, I was stupid to get a charge, but I don't think being thought of as guilty until proven innocent when there hasn't been a conviction is right either. I have no other record (my last speeding ticket was in 1995), and I have near perfect credit (798). Does anyone have any thoughts?

Not that I know of, but curious, what was the felony charge you got the deferred judgement for? Also, who blocked you from being appointed, if you still hold a valid license from the DOI?

I'd rather not disclose the charge...suffice it to say that it's a 2nd degree felony. As far as who blocked me, it was the parent company...Nationwide. I know that their standards are quite stringent, so it wasn't surprising. The reason I'm asking is that we are about to be able to write within other companies and we were curious about what the requirements were for non-principal agents within the other companies.

I think the type of felony will affect whether you can get a company to appoint you. If it was financially related or sexual probably not.

I think all companies ask about felonies on the application. Bankers Life probably wouldn't care. LOL

The problem is it's a felony and it's recent. It sounds like you're actually dealing with a situation where you were guilty and you're being spared some of the punishment in exchange for a "deal" of some sort. If you weren't "guilty", you wouldn't be on probation. If you still hadn't been proven guilty at worst you'd be out on bail, but you've got something else going on. Let's be honest here since you want honest information; the fact of the matter is you did something and you got caught, now you have to deal with the consequences.

To the issue of getting appointed, most felonies, especially recent, are going to pretty much be a no go. I'm painting with broad brush, but it's usually felonies and crimes of moral turpitude.

Not to worry, all is not lost.

What product(s) and line(s) are you looking to sell? It's illegal to split commissions with an unlicensed entity, but in most situations it doesn't matter what the appointment status is. If you still want to be actively working in the insurance world you could probably find another agent/agency willing to let you solicit/sell/etc on a commission split basis. Might not be the ideal solution, but something to give some thought to.
