Yes they made it out to me and mortgage company. Do you think I can fight them on this and try to get it changed so it's made out to me only?

There's nothing to "fight."

I don't think any insurance company will make out a check that size to just the insured when there is a mortgage company because, as "loss payee" the mortgage company has a right to control how the money is allocated and the insurance company could end up paying twice because of its contractual obligation to the mortgage company.

You'll have no choice but to endorse the check over to the mortgage company and then discuss your plans with whoever is in charge over there.

I would never be so foolish (again) to second guess an insurance company but you might present this to the company as a way to limit future losses by having all that money spent on a higher floor, safely away from future water damage.

The insurance company? Still won't get the check reissued to just the insured.
