I only named a few, and guess what, I live in Texas, and as mentioned I have been an Insurance agent for 18 years. I am sure that is longer than most on here.


3.) Where did I say other Insurance companies were perfect, and with out fault ?

What I did write is that none are perfect, (go read ) yet in my 18 years of doing this, I have never had 5 rescends in under a year with the same Insurance company, ( another guy on here wrote that he had 3 in one year with Time Insurance aka Assurant ) I guess in your opinion, he is an *** as well .....

I thought this board was a place for us agents to share things, so that maybe it might help another, but I guess I wrong, I guess this is a place to attack each other, or to find faults in each other.

oh well.....

I know this is frustrating but Somarco has a point. The fact that they left open a window for a rate-up versus outright cancellation is more than some companies would do.

Do you have access to the actual medical records that completely clears her of anything with her heart?

In my marketplace (CT), there are some state specific companies to my area that accept people on a strict accept/reject basis. Therefore, when I pre-screen customers with a few of these local carriers, if the customer gets approved there is no rate-ups or riders. This is specific to CT though. I don't have a magic bullet on a national scale. If you write in CT, email me privately and I will explain who I use in certain scenarios.

If you live in a state with many carriers or in a more urban/populated area, sometimes more localized HMOs have lenient underwriting that can be accept/reject without riders or massive rate-ups. Premiums just tend to start out a little higher though. Your state could possibly lack the options I have here for favorable underwriting (i.e. accept/reject, no rate-ups etc.)

To make matters worse in CT for Assurant, we only have rate-ups in CT and NH. No Condition Specific Deductibles (CSDs) and no riders. This makes them tougher to place business with if a customer doesn't care that a certain condition is ridered. Much of the storm around Assurant/Time originates from my state of Connecticut.

They could not afford the increase in premuim, and they were on the fence as to pay the 1700 to keep it from recsending, but really could not afford that either, both are good people, they took in thier 3 grandchildren to raise as the children's parents are going thorugh problems, they are good hard working honest people ( farmers )

And I never advised them not to take the rate up, infact I did the opposite, I said if you can afford it you should, even if you know you do not have a heart problem,., so that they would have a " Letter of Creditable Coverage" , and then we could find another policy.

Yes, as mentioned many times above, I read her medical file in detail, (infact she made me read it when I went thier, she wanted to show me she was not telling a lie ) when I went back out to put them on a new policy, I even submitted the entire folder with the application, they ( and I ) wanted to make sure this did not happen again to them.

Very interesting, thanks for the info. I have been in the insurance business in TN for 28 years but only started writing individual medical 3 years ago, I would always farm it to another agent. However, the IM market has been very profitable mainly from the ability to cross sell term, disability and LTC.

I'm not pretending to know the details. In my experience, Assurant has paid when they should and rescined when they should. You may have landed a very bad scenario here.

The conflict must revolve around whether the customer was advised to do heart follow-up and did not. If she was not advised to do so and Assurant is simply not paying, I imagine this could be fought.

Individual health is a great market to work in and often ignored by independent agents. I tell other indy agents that I just do individual health and they look at me like I have 5 heads. They have no idea. Many have never even thought of it.

In a market like TN, are there any local HMOs in Memphis or Nashville area that are pure accept/reject with no riders or rate-ups? The HMOs in my area are held to tougher standards than PPO/Indemnity. HMOs must offer maternity here. PPOs don't.
