I was never certain that this was a rule, but now that it isn't, I am :).

copy and paste from FMO email:

CMS Reverses Course On Rule 70.6 of the 2015 Medicare Marketing Guidelines!

This is great news! CMS has agreed to modify the above rule which severely limited your ability to call your own customers in order to market new plans that may be available in their area for 2015.

You now can…
"Call members to promote other Medicare plan types, (e.g., sponsors may contact their PDP members to promote their MA-PD offerings; sponsors that are also Medigap issuers may market their MA, PDP, or cost plan products to their Medigap customers), and discuss plan benefits."

You can call your members starting October 1 to discuss their current plan, new plans for 2015 and to set appointments for the upcoming AEP.
You are allowed to call your members now to set appointments for the 2015 AEP…but if you do so you are not allowed by CMS rules to discuss 2015 rates or benefits.

I had received something from Humana and had put it in another thread yesterday. Here's their guidance.
