Generic MA Mailer

My suggestion:

Make a copy of the page in the Medicare and You 20xx book that shows the different parts of Medicare, trifold that into an envelope, include your card, and on the back of your card write, "Call Me Regarding This."

The page is a CMS approved document, and by writing on the back of your card and not on the page, you haven't broken any regulations.

Do not paperclip your card to the page.

This leaves them open to ask you about Med Supps, Med Adv, Dental, PDP's, etc.

Always remember, on your dumbest day, you are smarter than CMS on their smartest day.

You don't need CMS filing and approval for a generic MA lead.

CMS clarified how and why generic leads are exempt from filing and approval in a March 30, 2009 memorandum on page 89 under the subhead "Multiple Organization Marketing Pieces Created by Agents".​

"Under certain circumstances agents/brokers that create customized materials will not be required to submit to the MAO or PDP sponsor for CMS review. Essentially, materials that are generic in nature and do not discuss content specific to plan benefits, cost sharing or include plan names will not require review and approval. Generic materials may reference the different product types (e.g., MA plan, MA-PD, Cost Plan, PDPs) offered by the agent."

Even though generic MA leads are exempt from the CMS Medicare Marketing Guidelines requiring prior filing and approval -- how the agent handles the returns is not exempt. All of the earlier prohibitions such as no door-to-door cold calling, plus the expanded September 15, 2008 regulations prohibiting outbound telemarketing, 48-hour "cooling off period", etc. -- these all still apply.​

Thanks for the reply. Great info. Let me clarify something... Are you saying, I can't call people that reply to my mailing because it would be classified as a cold call under the new CMS guidelines?

It wouldn't make sense to bother with the mailer it were the case. Please clarify.
 
You can call anyone who responds to a mailing -- even if they are on Do-Not-Call, even if they respond to a generic MA mailing. You only have 90 days to do that, though.

My reference to adhering to previous CMS marketing guidelines was for cold-calling, door-to-door, etc.

Once the prospect contacts you by return card or phone, they are "fair game" for the next 90 days.
