Our car was struck by another vehicle. The at fault driver had no proof of insurance and it was noted on the police report. Later when running a DMV check our adjuster found the vehicle was insured, but by the previous owner. The car had been sold to the at fault driver, who did not take out any insurance on it herself. For whatever reason Progressive did not cancel the insurance from the prior owner, it's unclear if the prior owner tried to cancel it or he just forgot. In the meantime we have no car to drive, our insurance won't get us a rental car under uninsured motorist, nor will Progressive because they haven't decided if they are liable or not, Are they liable if they failed to cancel the policy after the car was sold and title passed? Should one of them pay for a rental car for us? Our car may be in the shop for weeks through no fault of our own.
