That would be why I said its state specific. I can only recall hearing of one fraud suit in Tennessee over life insurance. The one John posted about awhile ago. Looked like clear fraud on the part of the agents. Smoking did come up, but that didn't appear to be the main issue. Also it was the agents that were being sued, not the insured.
 
Either the insured or the insurance rep are in deep doo-doo. That is a material misrepresentation of a material fact! That is why the life company copies the aps and application to the policy for the insured to look over. At best, the client would have the death benefit reduced to cover the actual insurance costs. I would imagine the outcomes only go downhill from there.
