Switching Policies After Trading Vehicles. Please Help !

ok here is the story:

5months ago I traded vehicles I called my insurance company to make the switch on my policy. today I was involved in a MVA and when I called the insurance company they now say they have no record of me switching. They say I called several times regarding quotes but that I never actually made the switch. But I know i did and even my bank had been calling them to get a copy of the policy.

I have no paperwork on this because all of it was handled over the phone and all my payments came out direct deposit due to being in the military and deploying it was just easier to make sure I took care of it all online. After they told me this sure enough I logged onto my account and there it still had the old vehicle listed.

I know I called them and made the switch and even had the friendly lady at the company congradulate me on my new car purchase.

Now I am out my 5k down payment and still owe the bank another 7k not to mentioned what I could get sued for by the other driver who apperently didnt carry a lick of insurance either and therefore doesnt have a policy with uninsured motorist.

Their team is reviewing my case to see if they will offer me coverage on the vehicle but in the meantime I am just sick with worry.

Where do I go from here and what will likely happen with all this?

If the other guy had insurance and the un-insured did pay out, that company would come after you anyway to pay them back.

I have to say this, This is ALOT your fault, did you never get an ID card to put in the car, did you ever check your policy online to see if the change was made? Some carriers, you can make the change yourself on line.

I would expect, the insurance company will pay the fix the other guys car/injuries since there was coverage, but not fix your car.

But really, you better hope someone is in a good mood when they review this.

Most states have a time phrase you are expected to replace the car,
 
Yes I realize this was a bad move on my part to not follow up but as I said being in the military I was deployed most of the time. and just thought nothing of it since it was all done automatically over the phone and the payment was made by direct deposit. I saw it come out on the 15th and just thought it was good to go.

And I am certainly hoping that someone is in a good mood and I have been in a constant state of prayer for a miracle.

The insurance company is mutual liberty though and from some of the reviews I have read after this they seem to not be a very good company. All I can do is hope at this point because my fate is literally in their hands and man what a learning experience this has been. If it was just a simple fender bender it wouldnt be so bad that they didnt fix it but my car is a total loss and undrivable.

If this works out I will send christmas cookies flowers you name it and I have prayed continually
 
Sorry about your accident and insurance woes. I hope things work out but I do want to say thank you for serving ouir country and God Bless You!
 
Put the facts on your side.
Get a copy of your phone records from the time. Show that you purchased your car and then called your agent. This will go a long way towards making this happen. If the phone records show you called your agent (to get a quote) and then bought the car, that might not go over so well.

The bank would have REQUIRED a binder be faxed to them for coverage. Ask them if they have a copy. Probably not, but maybe.

Since this was a car switch (not a coverge change????) they will verify what notes the agent has on making this change. Some carriers will accept the loss, others won't accept anything. It's really hard to say.

After the carrier does the review, post back here and let us know what they say. It will take a few days. For now though, you need to let them run the process.

WARNING:
If your car is in an impound lot, get it out. You will get stuck with excessive storage fees if it is allowed to stay there. If you drove your car home, you can ignore this warning.

Kurt, Also look up your states laws, depeding on when you purchased the vehicle, and when your policy renews, the laws could state that on a replacement vehicle your covered for X amount of days or until renewal with the same coverages that you had on the vehicle you replaced. For example, in Florida, I believe its 30 days for a newly acquired vehicle, with the same coverages as the vehicle with the most coverage on your policy (i.e. lowest deductibles). For a replacement vehicle, I think it could be as long as the renewal or 180 days. I am not sure on that part though and probably need to look it up. Your state might have a similar law.

If your vehicle wasn't insured, the state wouldv'e/shouldv'e suspended your license as well, so you may want to look into that too. Dan's advice above is very good.
 
For clarity, in California, they suspend the car registration, not your drivers license, for an uninsured vehicle. I'm not sure how other states work, but since people can have multiple cars and its not illegal to not insure your car (if you don't drive it), I assume most states only suspend your registration, unless caught driving without insurance.

Ahh, I did not know that differed state to state. In Florida they suspend your drivers license. Unless you turn your tag in, the insurance company notifies the state when the coverage is canceled and within 60 days the license is suspended. We see that a lot with non-standard, almost all of that business, at some point, had a license suspension it seems.
 
Well it was my fault for not checking to make sure the switch was made but after a seriously scary couple of days they did find the call log where I made the switch.

By the absolute grace of God, prayer, and some luck everything is fine and covered completely. Man I dont believe I have ever had something scare me this bad in my life.

Lesson learned here thats for sure.

Thank you guys for all the helpful suggestions though I really really appreciate it. Just knowing that there were people thinking about this and trying to help out on here was a great comfort during the wait.
