Group Health Question - VA

I know someone who is considering establishing a small group in Virginia.

I know what needs to happen, here in Georgia, but not for Virginia. Here in Georgia, you need a minimum of two people on the DOL 4 or Schedule K form, business must be in existence for six months minimum.

Does anyone know if this is the same for Virginia?

If they are a new company and they have articles of incorporation and w-4's for each employee, then they should have no problem.
