How Would You Modify the ACA?

You can still write exchange biz without taking the Advanced Subsidy....if they are due any subsidy they will just deduct it from the tax bill at years end.

Sure, tell someone making $25K that they need to pay at least 25% of their gross income for health insurance and that they should wait until the end of the year to get a refund from the IRS and not buy groceries for the next 12 months with the money they will eventually get back unless their income goes up.

You really have no clue, did you tell any of your thousands of ACA clients to do that?

Get rid of open enrollment and allow year round purchase but with a 90 - 180 day wait on p-x conditions.
Somarco, how long have you held this sentiment? Sounds exactly like what I'd like to see as well.

I gave you that idea. Ask the NSA to check your phone records. It will be there.

Somarco, your idea is too good for our gov't to attempt. That makes way too much sense.

Thanks, and of course it will never happen for precisely the reason you gave.

I don't know what planet you live on but here 50 single 25k pays 6.9% of income for a silver plan. Couple 50 & 46 25k pays just 4.5% of income for a silver plan. I know I know...... silly facts getting in the way of emotions.:D

What a dummy you are.

You claim they can take their subsidy at the end of the year, that means if they take your stated advice to avoid any potential clawback they have to pay the full premium for the whole year before they get the subsidy to offset the costs.

Premiums are capped at those levels AFTER the subsidy, you moron. That means they pay the full premium for the whole year.

Are you that effing stupid?

I feel really sorry for those poor souls that relied on you for help, all 5 of them really got screwed.

You are the freakin knucklehead dude:D

25k is 161% FPL in my last example. That is so FAR AWAY from 400%....why are you so paranoid about the "Clawback Boogeyman" ...............BOO!:D

I think that they should include dental/vision for adults in the ACA plans. It would certainly cut down on bad breath and traffic accidents.

A lot of people driving can't half see, and won't go and get glasses. I would be willing to bet that we'd see a sharp decrease in daytime accidents by adding eye care.

It's hard to imagine that someone could spend this much time allegedly reading about Obamacare in this forum and be so misinformed.

First you claim that they can take the credit at the end of the year rather than be subject to clawback.

Of course, that means someone under 250% FPL spending upwards of 25% of their income on health insurance, something that is impossible for anyone to consider.

Then, when that is pointed out, you fail to acknowledge that and claim that clawback only pertains to someone over 400%, which is completely wrong.

Here is the summary of the clawback provision, you ***:
Other Questions Regarding Subsidies

What happens if my income changes? Do I have to pay back subsidies?

Most consumers receiving premium subsidies will receive it in the form of an advanced tax credit, with the subsidy applied directly to the cost of their insurance. Since these amounts will be based upon your projected income for the year, the actualy amount of subsidies you are eligible will in many cases differ. If you end qualifying for more subsidies than any amount will be received in the form of a tax credit when income taxes are filed. What happens if you actually make more money and therefore qualify for less subsidies than you received?

In cases where households received higher amounts than they were ultimately eligible for, they are responsible for repayment of some or all of the tax credits they received. How much they have to pay back will depend upon their final household income. Households with a final income over 400% of FPL will be required to pay back the entire premium subsidy amnount. For those households with incomes under 400% of FPL, repayments will be capped at the following amounts

Income Range Repayment Cap

< 200% FPL $600 ($300 individual)
200% to 300% FPL $1,500 ($750 individual)
300% to 400% FPL $2,500 ($1,250 individual)

My point was that anyone subject to a clawback bill will be upset and someone who faces a $750 tax bill because they worked their butts off and made extra money during the year will not be a happy camper.

My educated guess is that you never told any of your clients about this, did you? Compare that to agents like myself who review this with everyone considering a subsidy application and maybe you can begin to understand why you shouldn't be in this business.

Of course not. He's blinded by the easy commission he's making and the one waitress that spilled soup on him at Denny's.
