What point? You wouldn't write B companies because E&O wouldn't cover it, but now you will if there is a POS. But in reality E&O would have covered you the same either way, except for insolvency.

All E&O will not cover companies that are not A rated.

But I was responding to why I said the POS was OK with me. The "point" was that it was a CYA for the agent.

And I don't not write Oxford because of their rating. I don't write Oxford because they have the previously declined question on the app.

I'd find new E&O then.

But I'm all for a POS. As you said, it covers the agent, me. It is going to be real hard for the insured or family to argue later on that they were never asked about the health condition causing a recession.

Ultimately though, with a signed app, it will be difficult for the family to argue it either. But a POS is just icing on the cake.

I use to wonder why the company really needed the policy back. But then I realized, if they are returning the policy, they have had it in their possession for all this time. If they felt it was wrong, they had plenty of time to read it and contact the agent or company about the discrepancy.

Regardless of whether E&O would cover it's hard to say the agent made an error or an ommission if there is a phone interview.

I have said in the past that I didn't write less than A rated companies because they weren't covered by E&O but I found out that I was wrong about that. I haven't said that since I found out I was mistaken, {actually misinformed}.

Oh, you can always say the agent made an error or omission. ;)

The hard part is getting it to stick.
