If they lost Part B in December, didn't have it in January, and it went back into effect in February, technically they can't use ICEP today. That would have had to be used for the MA to be effective the same month as the Part B. ICEP ended the last day of the month prior to Part B going into effect (January 31). I haven't heard of any changes to that rule, so if there was a change, I'd love for someone to share a link.
However, see if other SEPs apply to them.

I agree with Don that it was a dumb rule initially anyway. Glad it changed.
