MEC plan not meeting 60% actuarial value and employer penalty.

If you have a MEC that avoids the 2,000 EE penalty but doesn't meet the 60% actuarial value and a employee gets a ACA plan with subsidy will the employer be charged a 3,0000 penalty for that employee?
