Tree Company Drops Tree on House, what Should I Do?

He would not have to pay a deductible on his insurance his liability covers it with out deductibles. Is he willing to pay it all with out of pockets and you should be able to choose who ever you want to fix the roof and other damage. If
He is not willing to pay for it all then file against his insurance He will have a slight increase most likely on his insurance rates but I am sure the increase would be less the what it cost to do the repairs I would have him file a claim.
 
It's my moms, but I handle all of her insurance stuff for her, whether it be home auto etc

Your best bet is to have your mom file a claim on her insurance. Since she is not at fault it should not effect her home insurance. More likely the home insurance policy would pay to fix the roof and go after the tree guy and try to get the money back as in subrogation.:):cool:

Hmmm. In his phone call, he specifically said hendidntnwant to deal with insurance due to the deductibles and rate increase. How would liability cover the deductible? If we allow him to try to pay a company of our choosing to patch it, and we don't like the appearance due to discoloration of the new and old shingles and stuff, can we still file the claim?

Yea, we know we have that option, but we do want to give the guy a chance, he did give us a very good price for the work, and as mentioned before, he is a good friend of my neighbor. But obviously we want the work done right and to our satisfaction, we also aren't sure we like the idea of the patch, mainly due to the look of it being so different. We also still don't know if there is any underlying damage

The damage doesn't look major at all, should be pretty easy to fix. I know a lot of roofers who would do this probably for less than the deductible or rate increase.

Pictures don't show the whole roof, but if the roof is old enough that the shingles are so faded then realize the roof already was due for replacement. The tree company and the insurance are not responsible to replace it to 'new', just to what it was. For simplicity sake, they may pay to reshingle the back of the house, but there isn't a need for them to do that based on the pictures you sent.

I completely agree with you, I'm just going by what the roofer I called said, and that is that insurance would replace the whole back side of the roof in a situation like this. I never would have expected them to replace the whole thing, but if they will, I may as well take it right? :laugh::yes::laugh::yes:
But to my point anyway, why should I have to have a patched roof, it doesn't have other patches and looks uniform so why should I settle for a patched and un uniform looking roof because of their mistake?

Ohh and like I stated before, my carpenter things that it may leak now because of the damage, and we don't know if any of the roof rafters are cracked broken etc, same for the sheathing underneath
