I think that is a smoke screen on the carriers part........and I think the carriers know full well what the commission levels are going to be..........they just don't want to rock the boat.

How can actuaries price a plan post 9/23 without figuring in the compensation level??

You're right - they know but they're waiting to see if they can get agent comp left out of the MLR calcuations or if the MLR's get pushed back.

Do you have any insight on when that is going to take place???

From what I know, the carriers are in discussions with HHS as to how to calculate the MLRs as well as waiting for a response as to pushing them to 2014 when the exchanges are implemented.

My feeling is HHS isn't offering clarification at this point while they try to weigh the political toll. If they mandate these changes and it has a large negative affect, it could harm Obama. However, these changes were not only promised, but are current law.

By HHS backing off implementing that legislation, it could set a dangerous precedent and erode public trust.

IMHO, the MRL's will not be pushed back and carriers will release new comp schedules between Nov. and Dec.
