Problems with HCO?

I understand why you did, what you did. But i think i would have just got the client to sign a release, and then send the information they wanted. Then i would have started to move my book to another company. Even though you were right, I suspect the DOI did nothing to help you, right.

I offered to call in a 3 way with the client TO the carrier and she offered to give them a release.

They said they would not take it because they did not need it.

I told them I was instructed I would be breaking the law by answering and was ordered to answer.

DOI contacted the states attorney general office, who said it was a civil matter. No mechanisms exist at my state level for the DOI to help an agent in any way that is following their instructions, but I was SPECIFICALLY told by DOI that if I responded I would be violating HIPPA and they would have to report me.

State congressional offices were informed of the loophole in the law by the DOI, and the entire story has been sent to Senator Corker and Congresswoman Black's offices here in TN.

Congresswoman Black's office stated they are in contact with the Department of Labor, because they believe Humana's termination of me in this case violated Federal whistleblower statutes.

Government is slow, but they appear to be starting to roll down the hill on it.

I have no idea what the end result would be, but like I told them when I was terminated, I don't care about their major medical contract, after what they tried on this lady I would not be able to expose a client ever to a risk like this in good conscience.

However, their contract clearly states they cannot stop payment or change AOR on any policy if they opt out of the contract on the 30 day opt out clause, and I will do everything in my power to see the contract and the law enforced.

I swear it is not my intent to pile on cause as a business owner, you make some very valid points about getting into a mud fight in public. It looks bad and the nature of the back and forth RARELY works for the bigger of the two. That being said, my friend, once you enter the fray you've got to carry yourself and make sure you & your staff (Jen) come out, at least looking like you've taken the high road…..you failed in that regard.

As a bystander with no dog in the fight, I realize employees/agents/salespeople can be delusional in their request and expectations…….so I don't know if the agent's compliant is wacky or not but I will tell you, you bloody your own nose w/ how you and Jen handled this, on this PUBLIC forum.

As far as, I know Brook may be as fruity as a nutcake (no offense ,Brook..just an example) but your reactions and the way you guys carried yourselves were shocking to say the least……I was embarrassed for you, sir.

And given some of the hostility shown below in public , it would seem as if the impulse control shown in public (as illustrated below) is any indication of what private dealings would be w/ you and yours, my long held "decent guy" impression may have been given in haste

Again, I am NOT here to attack you, I'm just pointing out how you came across to innocent bystanders. Those of us that were just "looking at the car accident", you got out of your car w/ an "even" score card to me but you came across not as a reasonable business owner but way more like a kindergartener throwing rocks, first, logic later.

It was just disappointing to see more of an "angry elf" (Jen's quote) w/ hurt feelings throwing disparaging remarks ("[FONT=&quot]You can't go through life taking dumps on people")[/FONT]vs a leader of 3500 agents handle himself in a poised, manner.

Like I said, just disappointed in a guy I thought better of.

I'm surprised Scott wasted his time in this thread. I didn't even read every word and I already feel like I burned valuable minutes.
 
many years ago, i uncovered coruption on a military contract, with the DOD. I went to my senator, and congressman. Long story short is, they give you, lip service, but do nothing. I have no faith in the government, or the court systems. As glen is finding out. Vote for Ron Paul.. Bring our troops home.
 
my first post.....After going thru this thread, now I'm re-considering ny nearly closed decision to come back into the inurance business. Itis certainly displayed here that it is hard to judge even after 48 years passing since being cheated the first time by a Dist. mgr. that little has changed in that time, just changed faces and titles. After following this forum for nearly 5 weeks, several here had my respect on both sides of this, directly or indirectly involved. Well, I must re-evaluate, looks as if vacuum cleaners and used car dealerships still have my admiration! Sure would'nt want my laundry aired here in the future, and that comment is for both sides!!

Years ago I had my first lisence with a brand new health insurer. I was 22, due to death of my daughter and mothers distraught I asked DM to deliver the co.'s largest ever sold AP. Told him to explain to client that it was as I represented, and ask him to allow him to write DI app client had promised if policy read as I had represented. He did, both of them did. DM told me that the client had refused new app for DI. Few weeks later I receive from the co. a policy owners update, guess this, my policy owner had health policy and DI.

Few months later the Co. President and I by chance encountered each other, he wanted to know what happened to me? I told him and he said if I'd had let him knnow I'd been a DM. I said, "He was your first DM, I was your first agt. If he was example of what you hire, I do NOT need to come to know the others."

This thread indicated that nothing has changed! This is why when later I sold life ins. and became field trainer in 3 weeks my line to those less trusting of insurance people I said, "You need not worry about me or my policy, nothing to argue, you're living or dead. Living you pay, dead we pay. Very simple to understand!"

First post from me, or first AND last?? We'll see, I've learned to not be impulsive, try to be patient!
